1. Introduction
These Terms of Use ("Terms") govern the manner in which the User uses the Connecto platform ("Platform", "Service", or "Connecto"), operated by Connecto Digital ("Connecto", "we").
These Terms are complementary to and distinct from the Terms of Service (available separately). While the Terms of Service govern contractual, economic, and privacy matters, these Terms of Use describe the operational functioning of the Service and the reciprocal responsibilities involved in the day-to-day use of the Platform.
Acceptance of these Terms is mandatory for the use of the Service.
2. Description of the Service
Connecto is a SaaS (Software-as-a-Service) platform that enables the User to manage and automate professional networking and commercial outreach activities via LinkedIn, through integration with the User's own personal LinkedIn account.
Features include, by way of example and without limitation:
- Extraction and analysis of leads from LinkedIn searches
- Creation and management of outreach campaigns
- Automated sending of connection requests and messages
- Tracking of interactions and analytics
- Management of the User's professional profile
Connecto is an operational tool: it acts on behalf of the User based on the parameters configured by the User.
3. Integration with Third-Party Providers (Unipile)
3.1 Technical operation
To enable communication between Connecto and LinkedIn, the Platform uses the third-party provider Unipile (unipile.com), which specializes in technical integration with professional social networking platforms.
Through Unipile:
- The User connects their LinkedIn account to Connecto
- Credentials and session tokens are managed and stored by Unipile in accordance with its own security policies
- Actions configured by the User are executed through the APIs made available by Unipile
3.2 Technical limitations
The User acknowledges and accepts that:
- The proper functioning of the Service also depends on the availability and operation of Unipile's infrastructure
- Any updates, limitations, or suspensions of the Unipile service may affect the operation of Connecto, including temporarily
- Connecto does not control nor is responsible for the policies, fees, or technical changes imposed by Unipile
3.3 Authorization for integration
By accepting these Terms, the User expressly authorizes Connecto to use Unipile (and any other equivalent technical provider that Connecto may adopt in the future) as a technical intermediary for the provision of the Service.
4. The User's LinkedIn Account
4.1 Ownership and responsibility
The LinkedIn account connected to the Platform remains the exclusive property and responsibility of the User. Connecto acquires no proprietary rights or control over the User's LinkedIn account.
The User is solely responsible for:
- Maintaining the credentials of their LinkedIn account
- Compliance with LinkedIn's Terms of Service (linkedin.com/legal/user-agreement)
- The content and messages sent through their account, even when generated or configured via Connecto
- Any commercial communication directed at third parties, in compliance with applicable regulations (including GDPR)
4.2 Personal identification
The User warrants that the connected LinkedIn account corresponds to their real identity and that they have full rights to operate through such account.
5. Automation of Operational Actions
5.1 Consent to automation
By accepting these Terms, the User grants Connecto express and specific consent to automatically execute, on the User's behalf and based on the parameters configured by the User, the following operational actions through the User's LinkedIn account:
- Execution of searches and viewing of profiles
- Extraction of lead data from LinkedIn search pages (within Unipile's technical limits)
- Sending of connection requests
- Sending of messages to connected or open contacts
- Reading the status and updates of interactions
- Tracking of the lead journey within configured campaigns
5.2 Operational methods and limits
Connecto operates within technical parameters designed to simulate realistic professional use:
- Operating hours: automated actions are executed within working hours (by default 8:30–18:30 Italian time zone), on weekdays
- Progressive warm-up: in the first weeks of use, the volume of actions is increased gradually
- Rate limits: the number of daily actions is limited according to the subscribed plan and the parameters configured by the User
- Anti-ban layers: Connecto implements multiple technical layers of protection against the identification of automated traffic by LinkedIn
The User acknowledges that such parameters are risk mitigation measures and not absolute guarantees of non-detection.
5.3 Withdrawal of consent
The User may at any time withdraw consent to automation by disconnecting the LinkedIn account from the Platform. This action will immediately stop the execution of any active automation.
6. LinkedIn Restrictions and Behavior
6.1 Independent nature of LinkedIn
The User acknowledges that LinkedIn is an independent third-party platform with respect to Connecto. LinkedIn autonomously applies its own policies, detection algorithms, and rules of use, which may result in:
- Temporary limitations of account functionality
- Identity verification requests (challenges)
- Restrictions on messaging or connection requests
- Temporary or permanent account suspension
Such actions by LinkedIn are outside Connecto's control and may depend on multiple factors, including User behavior unrelated to the use of Connecto.
6.2 Disclaimer of liability
The User expressly accepts that:
- Connecto shall not be liable for any actions taken by LinkedIn against the User's account
- Connecto does not guarantee that the use of the Service is at all times compliant with LinkedIn's policies, which may change without notice
- Any sanctions applied by LinkedIn (including permanent account bans) do not entitle the User to refunds, indemnities, or compensation from Connecto
6.3 Best practices
Connecto recommends that the User:
- Use the Service moderately, avoiding volumes disproportionate to their professional profile
- Personalize messages sent, avoiding spam or generic content
- Maintain professional behavior compliant with applicable regulations
- Regularly monitor the status of their LinkedIn account
7. User's Responsibilities
7.1 Compliant use
The User undertakes to use Connecto:
- Exclusively for lawful professional purposes
- In compliance with applicable laws (in particular GDPR, anti-spam regulations, consumer protection code)
- Without causing harm to third parties
- Without sending unlawful, defamatory, deceptive, or dignity-harming content
7.2 Message content
The User is solely responsible for the content of messages and connection requests sent through the Platform, even when these are generated with the assistance of artificial intelligence tools provided by Connecto.
The User warrants that such content:
- Does not constitute spam, unsolicited communications, or unauthorized promotions
- Does not infringe third-party intellectual property rights
- Is truthful and not misleading
- Complies with applicable regulations on direct marketing
7.3 GDPR and commercial contacts
The User, as the party carrying out professional outreach activities through Connecto, acts in their own name and on their own behalf as data controller under GDPR with respect to message recipients.
The User is required to verify that they have an adequate legal basis for commercial contact (e.g., appropriately balanced legitimate interest, consent, performance of pre-contractual relations).
Connecto acts as a technical provider and not as data controller for recipients of campaigns configured by the User.
8. Limitation of Connecto's Liability
8.1 "As-is" service
The Service is provided "as-is" and "as available". To the extent permitted by law, Connecto disclaims all warranties, express or implied, including the warranty of fitness for a particular purpose, non-infringement of third-party rights, and uninterrupted availability of the Service.
8.2 No guarantee of results
Connecto does not guarantee specific commercial, economic, or networking results arising from use of the Platform. The success of campaigns depends on multiple factors (content quality, User profile, target recipients, market dynamics) outside Connecto's control.
8.3 Limitation of damages
To the extent permitted by law, Connecto's total liability for any damages arising from the use or impossibility of use of the Service shall never exceed the amount actually paid by the User to Connecto in the twelve (12) months preceding the harmful event.
Connecto shall in no case be liable for:
- Indirect, consequential, or incidental damages
- Loss of profit or loss of commercial opportunities
- Loss of data resulting from malfunctions of third-party providers (Unipile, LinkedIn)
- Actions taken by LinkedIn against the User's account
- Regulatory sanctions suffered by the User due to improper use of the Service in violation of applicable laws
8.4 Force majeure
Connecto shall not be liable for delays or non-performance caused by events beyond its reasonable control, including by way of example: interruptions of third-party services (Unipile, LinkedIn, Stripe, Supabase, Vercel, Cloudflare), infrastructure failures, cyber attacks, natural events, regulatory changes.
9. Changes to the Service and Terms
9.1 Service evolution
Connecto reserves the right to:
- Modify, update, temporarily suspend, or eliminate features of the Service
- Adapt technical parameters (rate limits, anti-ban layers, operating hours) based on the evolution of LinkedIn's policies or technical infrastructure
- Change technical third-party providers, maintaining the continuity of the Service
9.2 Changes to the Terms
Connecto may update these Terms of Use. Changes will be communicated to the User by:
- Email notification to the address associated with the account
- Notice visible within the Platform
Continued use of the Service after notification constitutes acceptance of the changes. In case of disagreement, the User may withdraw by disconnecting the account and ceasing use of the Service.
10. Termination
10.1 Termination by the User
The User may at any time:
- Disconnect their LinkedIn account from the Platform
- Cancel their subscription through the dedicated function in "Manage Subscription"
- Request the deletion of their account according to the GDPR procedures provided
10.2 Termination by Connecto
Connecto reserves the right to suspend or terminate access to the Service in case of:
- Violation of these Terms of Use or of the Terms of Service
- Unlawful, fraudulent, or harmful use of the Service
- Failure to pay the amount due
- User behavior that may expose Connecto to legal, reputational, or technical risks
10.3 Effects of termination
Upon termination of the relationship:
- The integration with the User's LinkedIn account is immediately interrupted
- Active campaigns are suspended
- The User's data is processed in accordance with the Terms of Service and the Privacy Policy
11. Intellectual Property
All intellectual property rights relating to the Platform, content, software, graphic interfaces, trademarks, and logos of Connecto are and remain the exclusive property of Connecto or its respective owners.
The User acquires solely a personal, non-exclusive, non-transferable, and revocable right to use the Service for the duration of the active subscription.
12. Final Provisions
12.1 Applicable law
These Terms are governed by Italian law.
12.2 Jurisdiction
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Court of Bologna, save for the application of mandatory consumer protection regulations.
12.3 Validity of individual clauses
The invalidity or ineffectiveness of any clause of these Terms shall not affect the validity of the remaining provisions.
12.4 Prevailing language
In case of discrepancy between the Italian version and translations of these Terms, the Italian version shall prevail.
